We collect information in the following ways:

2.1  Information You Provide Directly

When you contact us through our website’s contact form, we collect:

  • Your name
  • Your email address
  • Your phone number (if provided)
  • The content of your message or inquiry

2.2  Information Collected Automatically

When you visit our Site, we and our third-party analytics providers may automatically collect certain information about your device and browsing behavior, including:

  • IP address and approximate geographic location

  • Pages visited, time spent on pages, and navigation paths

This data is governed by both this Privacy Policy and the AWS Marketplace Terms of Service.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To fulfill and manage engagements initiated through the AWS Marketplace
  • To provide, operate, and improve our services and website
  • To analyze how visitors interact with our Site in order to enhance the user experience

  • AWS Marketplace: Transaction data related to engagements initiated through the AWS Marketplace is shared with Amazon Web Services as part of the Marketplace’s standard operating process. This is governed by AWS’s own privacy policy and terms of service.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid legal process, such as a subpoena, court order, or government request.
  • Protection of Rights: We may disclose information where we believe disclosure is necessary to protect the rights, property, or safety of Enkompass, our customers, or others, or to prevent fraud or illegal activity.
  • Business Transfers: In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our Site if such a transfer occurs and your information becomes subject to a different privacy policy.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Contact form submissions are retained for a period sufficient to respond to your inquiry and maintain records of our communications, typically no longer than three (3) years unless an ongoing business relationship warrants longer retention.
  • Analytics data is retained in accordance with the data retention settings of our analytics provider (Google Analytics default retention is 14 months).
  • AWS Marketplace transaction records are retained in accordance with applicable tax, financial, and regulatory requirements, which may require retention for up to seven (7) years.

When information is no longer needed, we securely delete or anonymize it.

7. Data Security

We take the security of your information seriously. We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction.

As an AWS-focused company, our internal systems leverage AWS security best practices including encryption at rest and in transit, IAM-based access controls, and continuous monitoring. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

In the event of a data breach that affects your personal information and requires notification under applicable law, we will notify you in accordance with those legal requirements.

8. Your Privacy Rights

Depending on your state of residence, you may have certain rights regarding your personal information. California residents have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request that we delete personal information we have collected about you, subject to certain exceptions permitted by law.

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. We will not deny you services, charge you different prices, or provide a different level of service based on your exercise of these rights.

Residents of other US states with applicable privacy laws (including Virginia, Colorado, Connecticut, Texas, and others) may have similar rights under their respective state laws. We will honor such requests to the extent required by applicable law.

9. Children’s Privacy

Our Site and services are directed to business professionals and are not intended for individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take steps to delete that information promptly.
